Will AG's Office get out of court settlement with JSC?

Will the Judicial Services Commission agree to have an out of court settlement after being approached by the Attorney General's Office?

The JSC chaired by Chief Justice Salesi Temo is seeking an order from the High Court to quash the findings and recommendations of the Commission of Inquiry into the appointment of Barbara Malimali as the Commissioner of FICAC.

The JSC's lawyer, Isireli Fa and the Office of the Attorney General's counsel Geraldine Naigulevu informed the High Court that they are discussing the terms of settlement and seeking time to progress.

Fa earlier said that the judicial review application by the JSC raises serious issues with the conduct of the COI and its findings and recommendations.

Fa had said in their opinion, its findings and recommendations are inconsistent with the evidence that was before the COI.
The case will be called today.

Questions have been asked why the out of court settlement is being sought and what is the offer on the table for the JSC.
