Solicitor General Ropate Green, who is the counsel for the Attorney General and the Commission of Inquiry into Barbara Malimali's appointment as FICAC Commissioner has told the court that they intend to keep some terms of settlement with the Judicial Services Commission confidential.
This comes as the matter where the JSC has filed leave to file for a judicial review seeking to quash the findings of the COI, was called before Justice Dane Tuiqereqere this afternoon.
Green did not disclose which terms they wish to keep confidential.
When questioned previously by fijivillage News outside court, he had also said he will not comment as the matter is still before the court.
However, when questioned outside court, the counsel for JSC Isireli Fa said he was happy with the terms they have settled on.
Meanwhile, in court today, Fa had intended to discontinue the case against the COI and the Attorney General as they were still discussing the terms of the settlement while the case against former COI Chair Justice David Ashton-Lewis would continue.
He said the case against Justice Ashton-Lewis would be continuing as they were still discussing costs to be paid to the former Chair.
Justice Tuiqreqere reminded Fa the orders he made on the 31st of December, stating that Fa cannot discontinue proceedings against one party.
He noted that he was not informed Green's position as he was given time until Tuesday to get instructions from his clients if they want the terms of settlement to be confidential.
Justice Tuiqereqere had ordered that if the terms of the settlement are not confidential, then it must be circulated to Nagin by the 16th of January.
The hearing on the terms of the settlement and the application by Fa to discontinue the case against Justice Ashton-Lewis will be held on the 22nd of January.
