Government MPs, Professor Biman Prasad and Manoa Kamikamica’s applications for permanent stay will be heard together.
Suva High Court Judge Justice Siainiu Fa’alogo Bull decided it this morning after hearing submissions from the counsel.
Justice Bull clarified that the cases are not consolidated in any way.
She says the decision was made to save the court’s time.
Professor Prasad’s lawyer, Richard Naidu and Kamikamica’s lawyer, Wylie Clarke highlighted that the common ground in both matters is the appointment of Acting FICAC Commissioner Lavi Rokoika.
FICAC lawyers Josann Pene and Joseph Work had earlier objected to this, saying the two matters are different.
Meanwhile, two journalists will give oral evidence in the matter.
The journalists are Jake Wise of The Fiji Times and Lavenia Lativereta of Mai TV.
Professor Prasad has been charged with two counts of failing to comply with statutory disclosure requirements.
He is also charged with providing false information in a statutory declaration after he allegedly recklessly submitted a declaration that omitted his directorship, rendering the document materially false.
Kamikamica is charged with one count of perjury and one count of giving false information to a public servant.
It is alleged that between 1st December 2024 and 31st March 2025 in Suva, Kamikamica knowingly made a false statement under oath, claiming that he had nothing to do with the appointment of the FICAC Commissioner.
It is further alleged that Kamikamica provided the same false information to the Commissioner of Inquiry.
The matter has been adjourned to 18th March for hearing.
