Hearing on former MSAF CEO's judicial review leave application on March 13th

The hearing on sacked Maritime Safety Authority of Fiji CEO Joweli Cawaki's leave application for a judicial review will be on the March 13th. 

Cawaki was suspended in October last year to allow investigations into matters surrounding Goundar Shipping vessel, Captain Inoke.

He was later sacked by the MSAF board. 

Cawaki's counsel Jagath Karunaratne says the board did not have the authority to sack him as Cawaki was appointed by the Minister. 

He also says MSAF did not follow the correct procedure as Cawaki was not given an opportunity to respond. 

The MSAF counsel, this morning before Suva High Court Judge Justice Savenaca Banuve, said they have preliminary issues relating to the jurisdiction of the court.

They raised that a judicial review can only be used if a decision is made by a statutory institution. 

They have questioned whether the issue can be dealt with a judicial review or through the Employment Tribunal. 

Justice Banuve has said that MSAF can make submissions on this in their response to Cawaki's application.
