Bail has been granted to Canadian national Joshua Aziz Rahman by the Suva High Court this afternoon.
Rahman appeared before Justice Thushara Rajasinghe this afternoon.
He was called today to check on his status as the Court of Appeal had ruled that Rahman get a retrial.
The Immigration Department had also issued a deportation order.
Justice Rajasinghe also asked why Immigration is adamant on deporting Rahman, as this is a case of national interest.
Rahman is represented by Devanesh Sharma and Gul Fatima, while the State is represented by Acting DPP Nancy Tikoisuva.
He is bailed for $2,000 bail bond with 3 sureties, he is not to change his residential address from Namena Road in Nabua, and has been told not to interfere with witnesses, and not to commit any offence while on bail.
A stop departure order has been issued to stop Rahman from leaving Fiji without prior approval of the court, and he is not allowed to travel outside Viti Levu without leave of the Court.
He has also been ordered to report to Nabua Police Station on Mondays and Fridays.
Rahman's conviction for being in possession of 39.5 kilograms of cocaine, was earlier quashed by the Fiji Court of Appeal, and his 23-year prison sentence was set aside.
It is alleged that the 31-year-old was found with cocaine worth $31 million in Caubati in February 2019.
The retrial date is yet to be set.
The case will be called again for mention on 13th April.
