Former Attorney General Aiyaz Sayed-Khaiyum's lawyer Devanesh Sharma has revealed in court that the decision in former Prime Minister Voreqe Bainimarama and suspended Police Commissioner Sitiveni Qiliho's no case to answer application has a bearing on his case as one of the contentious issues was what constitutes as a civil servant.

Sharma says this is another constitutional matter.

He adds they are still working on the pre-trial conference, the second phase of disclosures have been served and they are going through agreed facts.

Assistant Director of Public Prosecutions Elizabeth Rice has agreed with Sharma and says they have narrowed down some issues.

Sayed-Khaiyum's charge relates to a report lodged by the Acting Supervisor of Elections, Ana Mataiciwa.

Mataiciwa had lodged the report at Totogo Police Station in February.

It is alleged that Sayed-Khaiyum between June 30th and July 12th last year, while being the Acting Prime Minister, signed a Deed of Variation and Addendum between the Government and the then Supervisor of Elections, Mohammed Saneem.

It is alleged the approval for the government to pay the taxes of Saneem was done without the proper approval of the Constitutional Offices Commission and the President.

The case has been adjourned to the 27th of October 2023.
