Fiji Human Rights and Anti-Discrimination Commision lawyer Alefina Vuki says she thinks the Supreme Court’s ruling is a great opinion and they respect it.
She says all they need is a majority of the people working together in recognition of the sovereignty of Parliament because Parliament has its representative capacity as well.
Vuki says when those two are working together, they can actually make the imposed 2013 Constitution more democratic and more responsive to the needs of the people.
When asked about her thoughts on the Supreme Court’s opinion on not recognizing the 1997 Constitution, Vuki says you cannot have two instruments that are legally effective.
She says there has to be only one effective governing instrument.
She adds that the 2013 Constitution is operative and, by its operation, it has an effective capacity that the 1997 Constitution does not have.
