Bulitavu’s lawyer applies for the SODELPA case to be struck out with costs

SODELPA MP Mosese Bulitavu’s lawyer, Sushil Sharma has today applied for the case by SODELPA against his client to be struck out with costs.

This is in relation to the application filed by SODELPA Leader Viliame Gavoka for Bulitavu's seat in Parliament to be deemed vacant after he went against the party’s directives.

The judgement will be delivered on notice by this Friday.

In his submissions, Sharma has told the court that his client did not vote in support of the 2021/2022 National Budget and the Bill to Amend the iTaukei Land Trust Act in Parliament.

He says in the second affidavit, Gavoka said that it cannot be ascertained as to how the vote was taken and if Bulitavu supported Bill No. 17 and the National Budget.

Sharma says Gavoka had also stated that Bulitavu’s speech in Parliament made his intentions clear.

He adds by doing this, SODELPA is just placing a hypothetical scenario in front of the court in order to find out if Bulitavu was for or against the two bills.

SODELPA lawyer Romanu Vananalagi did not say anything in his response.

However they made an application to withdraw any action against the Speaker of Parliament and the Attorney General.
