The Judicial Services Commission chaired by Chief Justice Salesi Temo stresses that the legality of Lavi Rokoika’s appointment as Acting FICAC Commissioner is presently before the High Court, and any public explanation, defence, or justification by the JSC while the case is on foot risks interfering with the administration of justice.
The JSC states it will not compromise the integrity of the judicial process.
The Commission notes the ongoing public commentary and media queries concerning the appointment of Rokoika as Acting Commissioner of FICAC.
The JSC says the Commission’s constitutional mandate is clear.
It says the JSC makes recommendations to the President, upon consultation with the Attorney General in accordance with the Constitution and relevant law.
The JSC says it does not conduct public legal debates, nor does it adjudicate disputes through the media.
The JSC says it remains steadfast in its commitment to fairness, independence, and the rule of law.
It states that public confidence in the judiciary is strengthened not by commentary on live proceedings, but by allowing the courts to determine matters impartially and without external influence.
The Commission says will continue to discharge its constitutional responsibilities with integrity and independence.
The JSC earlier confirmed it will make decisions by the end of March regarding Barbara Malimali whose dismissal as FICAC Commissioner was declared unlawful by the High Court.
