He has seven active previous convictions since 2010

A man who was charged with the rape and assault with the intention to commit rape of his partner has been sentenced to 14 years imprisonment by High Court Judge, Justice Daniel Goundar.

It was heard in court that the man has seven active previous convictions since 2010, of which two are of sexual in nature.

The incident happened in Tailevu in 2018.

While sentencing the man, Justice Goundar says the man has not expressed any remorse for his actions adding instead, he was hostile towards the woman during her testimony.

He says on the day of the incident the woman was preparing to celebrate her daughter’s birthday when the man approached her for sex.

Justice Goundar says her response to his request was that she was busy cooking for the celebration adding the man got agitated and accused her for being unfaithful.

The Judge further says the woman did not react as she knew he had been drinking the previous night.

Justice Goundar adds in the evening when the victim entered her room the offender assaulted her and raped her.

The judge says the woman’s pain was unbearable.

He further says the woman wanted to go to the hospital but the man stopped her adding he was concerned that he would be exposed when the doctor will see the woman’s physical injuries.

He says two days later when the man left the home for work, the woman reported the incident to police

A non-parole period of 12 years has been set.
