Justice Temo finds Timoci Lolohea guilty of murder

Timoci Lolohea has been found guilty of murder.

High Court Judge, Justice Salesi Temo has found Timoci Lolohea guilty of murder.

Justice Temo concurred with all the three assessors in the trial who also found Lolohea guilty.

Lolohea killed his 23-year-old defacto partner by stabbing her with two knives on 20th March last year at Nasilivata Street, Nadera.

Justice Temo stated that the defence of provocation does not apply as there was a lot of time for the 56-year-old to cool off after finding out about his defacto partner's affair.

He adds that mental illness does not apply as no evidence was given regarding that.

While summing up the case, Justice Temo stated that the prosecution's case was that Lolohea intended to kill his defacto partner.

He adds that the defence case was that Lolohea was provoked by the deceased into killing her.

Justice Temo also stated that the defence relied upon mental impairment however the law does not give a blanket cover for those suffering from mental illnesses.

He says Lolohea in his evidence said that he was physically and mentally fit every time he returned from an overseas tour.

Justice Temo stated that as per Lolohea's evidence, he had never sought psychiatric help but instead he drowned himself in alcohol.

The prosecution has sought a mandatory life imprisonment with 30 years as a minimum term to be served before a pardon can be sought.

Defence lawyer Lisiate Qetaki has sought for 15 years as a minimum term to be served.

Justice Temo then said that in the colonial time, people were hanged for murder.

Lolohea will be sentenced at 12pm today.
