Ex-servicemen’s $25B peacekeeping allowance dispute case adjourned to next month as Court of Appeal matter pending

The case where 5,000 ex-servicemen allege they were not paid $25 billion in allowances for peacekeeping missions for United Nations Interim Force in Lebanon between 1978 and 2002 has been adjourned to next month to check on the status of the case in the Court of Appeal.

The ex-servicemen have filed a civil case against the Republic of Fiji Military Forces, the Minister for Home Affairs and the Attorney General.

The RFMF had filed a strike out application in the Court of Appeal and the ex-servicemen's counsel Isireli Fa had filed a counter strike out application to strike out RFMF's application.

Fa had appealed on the basis that a strike out application can only be filed after a Statement of Defence has been filed.

The Appeal's Court had granted leave to appeal and a stay in the proceedings in the High Court was granted.

RFMF's counsel informed Acting Master of the High Court Liyanage Kashyapa Wickramasekara that they have filed their Statement of Defence.

The Acting Master says he cannot proceed with the case until the Appeal's Court matter is dealt with.

Fa has indicated that he will file an application in the Appeal's Court to vary the ruling to allow for the stay in proceedings in the High Court to be lifted.

The matter has been adjourned to the 27th of November.
