FCCC demands cease of conditional sale of Coca-Cola Games ticket

A formal demand notice has been issued by the Fijian Competition and Consumer Commission to the Fiji Secondary Schools’ Athletics Association to immediately cease and desist the conditional selling of the 2024 Coca-Cola Games tickets while the organizers have confirmed they are in the process of selling tickets as a 3 day package and for individual days.

FCCC says the Association was allegedly selling tickets engaging in the sale of event tickets specifically requiring the purchase of three day ticket instead of offering the option of daily attendance tickets.

FCCC CEO John Abraham says this practice is in direct violation of Section 87(e) of the FCCC Act 2010, which prohibits the refusal to provide goods and services unless other goods and services are also purchased and potentially also violates Section 76 of the Act which prohibits unconscionable conduct.

He says they have received a complaint and confirmation that people have started purchasing these tickets however, the ticket prices have not been advertised yet on the organiser's website as per preliminary investigations.

Abraham says should the Association fail to comply with this directive, FCCC reserves the right to initiate injunction proceedings against the Association to compel compliance with the law and to cease conditional selling practice and potentially, charges could be laid for breaches of the Act.

The CEO says they have also received confirmation that some people have purchased tickets at $65 and that they have been offered a bundle so they cannot buy the ticket for one particular day.

Abraham adds that artificially and unilaterally increasing the price from the previous years without giving any cost justifications and bundling it up is a practice that is a direct violation of the FCCC Act.
