Winding up petition against TFL stayed

The winding up petition filed by Digicel Fiji Limited against Telecom Fiji Limited has been stayed by Chief Registrar Ana Rokomokoti this afternoon.

The court battle between the two telecommunication providers is now heating up as counsels from both sides made lengthy submissions behind closed doors this morning.

Lawyer Devinesh Sharma appeared for TFL while Chan Young represented Digicel.

After the hour long submissions, both counsels confirmed that Digicel issued the winding up petition against TFL as it claimed that TFL owes them $880,000 under the interconnectivity arrangement between the two parties.

However, TFL today submitted that Digicel owes them more than $880,000 and as such they cannot be the creditors and are not in a position to issue a winding up petition against Telecom Fiji Limited.

After hearing from both parties, the Chief Registrar ordered that the winding up petition be stayed and both sides be given an equal opportunity to present their case in court.

The case is adjourned to next Wednesday for mention when a court date is expected to be assigned for the case to be heard in open court.
