Saneem confirms LinkedIn post in his defamation case against Assistant DPP Tabuakuro remains online

Former Supervisor of Elections, Mohammed Saneem has confirmed in court that the LinkedIn post related to a defamation case he has filed against Assistant Director of Public Prosecutions Laisani Tabuakuro, still remains online. 

Saneem has filed the case against Tabuakuro after he shared a Fiji Government post where the then Attorney General Graham Leung had called on the then Acting DPP John Rabuku to step down as the Supreme Court gave its opinion that Rabuku is not eligible for judicial appointment because he was previously found guilty of professional misconduct in a disciplinary case.

Saneem claimed the appointments and terminations were unlawful and accused the State of abusing its office and failing to act as a model litigant.

In response, Tabuakuro accused Saneem of spreading lies, called him an unethical lawyer, and said the Supreme Court had not ruled on the issue and that there were no problems with his criminal charges.

While taking the stand during the hearing today, Saneem said Tabuakuro does not have the right to comment as she is also the Acting DPP and her code of conduct does not allow it. 

He also says he felt attacked and she was very unprofessional. 

Saneem says the Supreme Court ruling does not mean she can call someone a liar.

During cross examination, he confirmed that the post remains online and he continues to run his law firm.

He also wants Tabuakuro to apologise and remove the comments.

Ministry of Policing and National Communications Manager Cyber Security and Digital Forensics Savenaca Siwatibau confirmed that Tabuakuro cannot delete her post, however, Saneem can delete and block it. 

fijivillage News journalist Mansi Chand and MaiTV journalist Lavenia Lativerata also took the stand this afternoon where they confirmed that Saneem was charged by the Office of the Director of Public Prosecutions with a count of receiving a corrupt benefit but he was acquitted by Chief Justice Salesi Temo. 

The hearing continues tomorrow where Acting DPP Nancy Tikoisuva, Tabuakuro and Deputy DPP John Rabuku are expected to give evidence.
