Hearing on leave for judicial review applications into COI report set for December 12th

The hearing date for the leave for judicial review applications in relation to the Commission of Inquiry report into the appointment of Barbara Malimali as FICAC Commissioner, has been set for December 12th.

Former Attorney-General Graham Leung and Fiji Law Society President, Wylie Clarke, informed the court that they intend to seek overseas counsel.

Malimali’s lawyer, Tanya Waqanika earlier stated that they are seeking to have the Commission of Inquiry report quashed and are also claiming damages.

The Judicial Services Commission is also seeking an order to quash the findings and recommendations of the Commission of Inquiry, along with other related declarations.

The respondents have been given 14 days to file their affidavits in opposition, while the applicants will have a further 14 days to respond thereafter.
