Khan to Get Confiscated Items Back

Suva Magistrate Aminiasi Katonivualiku has today ordered that the three vehicles and items which were taken by police from businessman Ballu Khan's home be returned to him, as the items were taken without a warrant.

It was revealed in court today that the complete set of items include a DVD player, video camera, a digital camera as well as the three vehicles.

DPP lawyer Aca Raiyawa then made an application for a stay order on the decision made by Magistrate Katounivualiku in regards to the release of items and the vehicles, however, defense counsel Graham Leung opposed the stay order application.

Magistrate Katonivualiku also told the court that the trial proper is to be heard in the high court as he himself does not have the jurisdiction to hear Khan's case, whereby Khan is charged with three counts of conspiracy to murder.

Khan is free to move around to and from the Suva Private Hospital without police interference and is also free to reside at his home at Kavika Place.

However, Khan's curfew conditions remain the same that is from 6pm to 6am. Bail is extended and the case is to be heard on the 21st of January in the Suva High Court.
