Prime Minister Sitiveni Rabuka's lawyer, Simione Valenitabua says they are in the process of completing their affidavit after High Court Judge, Justice Dane Tuiqereqere directed the parties in the judicial review challenging the Commission of Inquiry into the appointment of FICAC Commissioner Barbara Malimali to provide clarifications ahead of the judgement on Monday.
Justice Tuiqereqere directed the Government respondents, which include the Commission of Inquiry, the President, the Prime Minister and the Attorney-General, to confirm whether Malimali and her lawyer were excluded from the oral evidence of key witnesses during the Commission of Inquiry hearings.
The list of witnesses includes Prime Minister Sitiveni Rabuka, Chief Justice Salesi Temo, former Deputy Prime Minister Professor Biman Prasad, Deputy Prime Minister Manoa Kamikamica and others.
If there is no dispute, the respondents are required to provide the reasons.
This is the matter where Malimali, former Attorney-General Graham Leung, and lawyers Wylie Clarke and Laurel Vaurasi filed for a judicial review of the COI report.
The hearing was held in April and Justice Tuiqereqere is expected to deliver his judgement on Monday.
