JSC and COI, AG settle outside of court in COI matter

Settlement does not involve Justice David Ashton-Lewis

The Judicial Services Commission and the Commission of Inquiry into the appointment of Barbara Malimali as FICAC Commissioner with the Attorney General, have made an out of court settlement.

This is regarding the matter where the JSC was seeking an order from the High Court to quash the findings and recommendations of the Commission of Inquiry into the appointment of Barbara Malimali as the Commissioner of FICAC.

The Counsel for the JSC, Isireli Fa has filed the terms of settlement and has told High Court Judge Justice Dane Tuiqereqere that they would like the terms recorded as court orders.

He says this settlement does not involve COI Chair Justice David Ashton-Lewis. Fa says they are discontinuing the matter against the COI and the Attorney General.

The matter has been stood down until Justice Tuiqreqere reads the terms.

He has also raised questions on who has the authority over the COI as it no longer exists.

Justice Tuiqreqere has also asked what authority does Justice Ashton-Lewis have now, with the COI now completed. Stay with us for updates.
