Imran Khan’s application to vacate guilty plea ruling set for July 9th

Imran Khan’s application to vacate guilty plea ruling set for July 9th
Suva High Court Judge Justice Thushara Rajasinghe will deliver his ruling on July 9th in a matter where Imran Khan, also known as King Khan, has filed an application to vacate his guilty plea on one count of contravening a restraining order.

Defence lawyer Shayal Kant says Khan did not fully understand the nature of the charge and the consequences of his guilty plea.

Justice Rajasinghe says Khan understood the charge and had told the court that he pleaded guilty of his own free will, without threats, and was aware of the consequences.

He says if Khan did not understand the summary of facts, he should have raised it at the time, as two hours had been given.

Justice Rajasinghe further says that if accused persons change their minds after the court has followed the proper procedures, court proceedings would never end.

Kant says it is the duty of lawyers to explain the pros and cons of a plea.

Justice Rajasinghe says if the court refuses the application, the sentencing will proceed on July 14th.

40-year-old Khan had transferred a vehicle, which was subject to a High Court restraining order, to his brother.

The initial restraining order also included a $400,000 property, cash currently held at a local bank and four vehicles.
