Samuela Tawase appeared before High Court Judge Justice Daniel Goundar this morning.
Justice Goundar has set aside the judgement by the Magistrates Court saying that it had no authority to impose the order of releasing Tawase into the community.
Tawase will undergo full rehabilitation and assessment at St Giles by the medical superintendent.
Samuela Tawase was involved in a sacrilege case at the Shiv Temple in Samabula last year and discharged by the Suva Magistrates Court for compulsory community treatment.
Tawase was represented by Legal Aid senior counsel Timoci Varinava, while Livai Tuivuya represented the Office of the Director of Public Prosecutions.
