Police document submission delays lead to withdrawal of charges in Constable Racagi's death

Charges against two men accused in relation to the death of Police Constable Peniasi Racagi were withdrawn after delays by police in submitting supporting documents to prosecutors.

Commissioner of Police Rusiate Tudravu says Director of Public Prosecutions Nancy Tikoisuva had briefed him on the reasons behind the decision to discontinue the case on Friday.

Tudravu says he accepts full responsibility on behalf of the organisation for the delay in submitting documents required by the prosecution.

He says immediate internal measures have been initiated following the briefing from the Office of the Director of Public Prosecutions to identify procedural shortcomings in the handling of the matter.

The Police Commissioner says disciplinary action has also been directed against officers responsible for the delayed submissions.

Tudravu says pending investigation reports and expert findings will be resubmitted, while the investigation file relating to the alleged involvement of police officers will also be forwarded to the ODPP for review before independent legal advice is rendered.

He says the Fiji Police Force respects the judicial process and court decisions, and will ensure compliance with legal procedures to avoid causing unnecessary trauma to the families involved.

Tudravu has assures the family of the late Police Constable Peniasi Racagi and the public that justice will prevail and those responsible will be brought to justice.
