High Court ruling on Waqanika's permanent stay application deferred to Friday

High Court Judge Justice Siainiu Fa'alogo Bull will now deliver her ruling on Friday in the matter where Suva lawyer Tanya Waqanika and her counsel and sacked FICAC Commissioner Barbara Malimali have applied for a permanent stay against charges laid on Waqanika by FICAC.

The ruling was expected to be delivered this afternoon.

They are challenging Lavi Rokoika's appointment as acting FICAC Commissioner.

During the hearing, Malimali also argued on the de facto officer doctrine, which upholds the validity of acts performed by a person acting in an official role, even id their appointment is later declared invalid, is not applicable. 

Meanwhile, Justice Bull refused former Deputy Prime Minister Manoa Kamikamica’s application for a permanent stay in proceedings brought against him by FICAC.

He had also argued on similar grounds.
