Register or apply for exemption if unsure about media definition

Organizations and institutions that send out newsletters should get their own legal advice and apply for a media registration or an exemption if in doubt following the promulgation of the Media Decree.

Under the decree, the definition of a media organization is any person or other entity, however organized, who or which disseminates information, news, opinion, entertainment, advertisements, and similar items to the public by way of newspaper or magazine publication, radio or television broadcast, audio visual presentation or other print or electronic means of communication and includes print and broadcast media, and internet website.

The decree states that those who are not defined as media organizations are internet service providers, telecommunications service providers, production houses and any person or body corporate that is granted an exemption by the minister.

Solicitor General Christopher Pryde said individuals and organizations need to get independent advise and he cannot say anything on whether institutions like schools or corporate bodies who send out newsletters are exempt under the decree.
