High Court grants the Fiji Times leave to apply for judicial review

The High Court has granted the Fiji Times leave to apply for judicial review of the Government’s decision to award its advertising contract for 2016 to the Fiji Sun.

The Fiji Times have been refused a stay of the Government’s decision and the current arrangement will continue until the application is heard.

The Court held that the conduct of the Fiji Times does not support the grant of stay and there is no evidence of irreparable loss to Fiji Times that warrants a stay.

Fiji Times application to stop Government from continuing to advertise with The Fiji Sun has been refused until the determination of the application for judicial review.

The granting of the application does not mean that the decision to award the contract to the Fiji Sun is impugned or called into question.

The Fiji Times has been given permission to submit an application for judicial review.
