The counsel for the Department of Environment has maintained that the documents being sought by Next Generation Holdings (Fiji) Pte Limited in its appeal case are internal documents and will not be disclosed.
This is the matter where TNG has appealed the Department of Environment’s decision to reject its proposal for a $1.4 billion waste-to-energy plant at Vuda Point.
The matter was called before the Environment Tribunal, presided over by Magistrate Charles Ratakele, today.
Department of Environment counsel Pete Bauleka has asked TNG counsel Feizal Haniff to provide reasons in a letter explaining why the documents are relevant to their case.
Haniff told Magistrate Ratakele that if Bauleka maintains that the documents will not be disclosed, he will make an application for them.
Magistrate Ratakele has given Haniff until 7th September to write the letter and the Department until 17th September to respond.
If the Department’s response is negative, Haniff has been given until 24th September to file the application.
The matter has been adjourned to 24th September.
