The Suva High Court has ruled that the Commission of Inquiry, President, Prime Minister Sitiveni Rabuka and Attorney General are jointly and severally liable to pay 60 percent to Barbara Malimali, Wylie Clarke, Laurel Vaurasi and Graham Leung in cost.
While delivering his ruling, Justice Dane Tuiqereqere said the first applicant, Barbara Malimali is entitled to costs of $13,615, while the second applicants, Wylie Clarke and Laurel Vaurasi are entitled to $207,426 and the third applicant, Graham Leung is entitled to $139,944.
He says the costs must be paid to them within one month of the date of the decision.
Justice Tuiqereqere had earlier declared that the Commission of Inquiry report into the appointment of Barbara Malimali as FICAC Commissioner was null and void in its entirety.
The applicants who challenged the Commission of Inquiry report through judicial review were former FICAC Commissioner Barbara Malimali, former Attorney-General Graham Leung, and lawyers William Wylie Clarke and Laurel Vaurasi.
Justice Tuiqereqere didn't make any orders as to damages.
