The FICAC trial against former Deputy Prime Minister Professor Biman Prasad will continue in the Magistrates Court after his application for a permanent stay of proceedings was refused.
The defence had sought a permanent stay, arguing that FICAC deliberately withheld two NFP statements, as well as other statements that could have been relevant to the defence.
While delivering the judgement, Suva High Court Judge Justice Thushara Rajasinghe said Professor Prasad’s right to a fair trial had not been compromised.
Justice Rajasinghe therefore refused and dismissed the application for a permanent stay.
The matter is likely to be called in the Magistrates Court tomorrow.
Professor Prasad is charged with two offences relating to alleged non-disclosure in his 2015 statutory declaration while he was an office holder of the National Federation Party.
