Lawyer Jerry Dinati has informed the Suva High Court that his client, Isaia Ledua, was not informed of his rights when his DNA sample was taken.
Ledua appeared before Suva High Court Judge Justice Dane Tuiqereqere, charged with one count of attempted aggravated burglary over allegations that he attempted to break into the RFMF armoury in Nabua between April 8th and 9th, damaging the door-lock keypad.
Justice Tuiqereqere directed the prosecution to provide further disclosures this week.
He also advised the parties to complete the necessary pre-trial processes ahead of the hearing.
The court has set aside two days for a voir dire hearing in April next year to determine whether the DNA evidence can be admitted at trial.
The matter has been adjourned to next Thursday for a pre-trial conference.
