The Suva High Court will deliver its ruling on the no case to answer involving former Prime Minister Voreqe Bainimarama, former Attorney General Aiyaz Sayed-Khaiyum and former Minister for Health Dr Neil Sharma on 4th December.
This is in relation to the Health Tender case.
The case was called today before Suva High Court Judge Justice Usaia Ratuvili.
Assistant DPP Laisani Tabuakuro sought more time from the court to make her submissions, saying she had not been able to file them.
She says she had received the submissions on behalf of Bainimarama and Sayed-Khaiyum.
However, on Tuesday this week, she learned that Wylie Clarke would not be filing submissions on the preliminary issue.
Clarke confirmed in court that he would not be filing submissions today, saying they would not be addressing the court on the supplementary issue.
He says that is the reason they will rely on their fiscal and class submissions in respect of the cases they have already filed.
It is alleged that Hospital Engineering and Consultancy Ltd, also known as Hospineer, was favoured in the procurement of three biomedical analysers through a waiver of the tender process instead of the recommended bidder.
Bainimarama is charged with one count of abuse of office.
Sayed-Khaiyum is charged with one count of abuse of office and one count of obstructing the course of justice.
Dr Sharma is charged with two counts of abuse of office and two counts of breach of trust by a person employed in the public service.
