A 61-year-old retired military officer has been sentenced to three years, 10 months and three weeks’ imprisonment for indecently assaulting his nephew’s daughter in 2021.
While delivering the sentence, Nasinu Magistrate Krishan Prasad said the offender had breached the trust of his granddaughter, who was nine-years-old at the time of the incident.
Magistrate Prasad says the victim looked up to the offender as an older family member and had to relive the trauma during the hearing.
While giving evidence, the victim expressed that she felt her complaint had broken her family after she finally disclosed the incidents to her teacher.
Magistrate Prasad says the sentence was intended to protect vulnerable members of society, such as the young victim, from lascivious-minded predators and to allow the offender an opportunity to reflect on his actions.
He set a non-parole period of three years.
Magistrate Prasad also issued a permanent DVRO to protect the victim from any further acts by the offender.
