The lawyer representing the plaintiffs in the ongoing Vatulaulau Hindi Cemetery trustees says there was never a court order preventing the family of the late Arun Kumar from accessing the cemetery for his funeral.
Lawyer Vikrant Chandra says an application was made to allow access to the cemetery for the funeral of the late Arun Kumar, a bona fide member of the Vatulaulau community, which was scheduled for 8th May this year.
Chandra says the plaintiffs consented to the application, and there was no ruling by the court stopping the family from entering the cemetery.
He says the defendants believed they would be prevented from accessing the property, which is why the application was filed.
Chandra says the matter has since been portrayed in a way that has led the general public and the defendants to believe they had won the case, even though the substantive matter remains before the High Court and is sub judice.
The comments come after the High Court in Ba granted an interim injunction restraining individuals appointed at the disputed Annual General Meeting of the Vatulaulau Hindi Shamshanbhoomi on 28th February 2026 from acting on behalf of the trust until the court determines the matter.
The court also ordered that any dealings with the organisation's Bank of Baroda account must be approved by all trustees pending the outcome of the proceedings.
