Judgment for Madigibuli to be delivered on May 12th

Suva High Court Judge Justice Dane Tuiqereqere will rule on the 12th of May on whether Apisai Madigibuli murdered his 25-year-old wife in 2024.

It is alleged that he killed his pregnant wife at an apartment in Waimanu, Suva, on the 26th of April, 2024.

During closing submissions, Principal Legal Officer for the DPP, Sadaf Shameem said they have proven their case beyond reasonable doubt.

Shameem says there have been no signs of remorse or empathy shown by Madigibuli.

She says there is sufficient evidence identifying Madigibuli as the person who committed the crime and that he confessed to his siblings that he killed his wife.

Shameem says there are clear indications that it was an intentional murder.

She says he had explained that when he first struck his wife, he was not satisfied.

She also says that he used words like 'I planned to kill her' and 'I told her that I could kill her'.

Justice Tuiqereqere asked the State to justify why Madigibuli was kept in custody for 48 hours.

Shameem says police had reasonable grounds to detain him because he was arrested at the crime scene.

She further says there were no special court sittings over the weekend and therefore his case was called on the 29th of April.

She says there was no police brutality.

A written submission was read in court in response to the State’s submission regarding the 48-hour period.

Madigibuli wrote that he was put in a water drum.

He says he was forced to admit to the killing.

Madigibuli highlighted that the State’s submission should be rejected and that he should be acquitted.

He is charged with one count of murder.
