The Suva High Court will deliver its ruling tomorrow morning on the review of the special verdict in the case of the man who was discharged in relation to sacrilege charges relating to an incident at the Shiv Temple in Samabula.
Samuela Tawase was involved in a sacrilege case at the Shiv Temple in Samabula last year and discharged by the Suva Magistrates Court for compulsory community treatment.
He, who was who was accused of one count of sacrilege, appeared before High Court Judge Daniel Goundar.
Tawase was represented by Timoci Varinava, while Livai Tuivuya represented the Office of the Director of Public Prosecutions.
Tuivuya is arguing that the Magistrates Court erred in its judgement, as the learned Magistrate had the power to commit Tawase to Saint Giles Hospital but not the power to enforce community treatment.
Justice Goundar stated that only the doctors can give an order for community treatment and not the Magistrate.
Acting Superintendent of Saint Giles Hospital, Dr Kiran Gaikwad had confirmed that Tawase was not in the right frame of mind when the incident occurred.
