High Court to rule on validity of COI report on 3rd August

The High Court will decide on the 3rd of August on whether the report of the Commission of Inquiry into Babara Malimali's appointment is valid or not when Justice Dane Tuiqereqere delivers his ruling on the judicial review of the COI.  

The review has been filed by Malimali, former Attorney General Graham Leung and lawyers Wylie Clarke and Laurel Vaurasi. 

The applicants argued that they suffered reputational damage, they were not afforded natural justice and the opportunity to respond to the allegations made by COI Chair Justice David Ashton Lewis and the Chair was biased against them. 

They also argue that the investigation went beyond the Terms of Reference and the hearing was extended without a gazette.
