Susana Radinivugalei has been convicted of one count of manslaughter arising from a breach of duty and sentenced to two years imprisonment, suspended for three years, over the death of her grandson who was in her care.
On the 29th January this year, Radinivugalei was taking two of her grandchildren, including Elijah Jibola, to school along Mission Road in Sigatoka.
She crossed the road at a pedestrian crossing in Sigatoka Town with her elder grandchild, leaving Elijah about 10 metres behind.
Radinivugalei and the elder child reached the other side safely, while Elijah attempted to cross the road on his own he was hit by a car.
He was rushed to Sigatoka Hospital, where he was pronounced dead on arrival.
Radinivugalei admitted her negligence and pleaded guilty to the charge of manslaughter arising from a breach of duty.
Justice Sunil Sharma accepted that she was genuinely remorseful, had fully cooperated with police investigations and had no previous convictions.
Justice Sharma says that Radinivugalei had already suffered the devastating loss of her grandson and continues to care for her other grandchildren.
However, Justice Sharma stressed that the offence was serious and that the tragedy could have been avoided had the child not been left unattended, adding that no amount of repentance could bring the child back.
As part of the sentence, Radinivugalei must complete two sessions of general and parental counselling through the Ministry of Women, Children and Social Protection within three months. Failure to comply with the order could result in committal proceedings.
Meanwhile, the driver, Komal Sapna Singh has pleaded not guilty to a charge of manslaughter.
Her case has been adjourned to 4th August for a pre-trial conference, and her bail has been further extended.
