The Suva High Court has discontinued the case of 36-year-old Sanjay Naidu who was charged with the rape of a 12-year-old girl in November in 2016.
The Office of the Director of Public Prosecutions had made an application to discontinue the case.
It was alleged that the offence took place while Naidu who was a bus driver was on his last trip and committed the offence along one of the bus stops along Princes Road in November in 2016.
Police had confirmed in 2016 that the victim had boarded the bus from Nausori and had fallen asleep missing her stop.
