Court to deliver ruling on notice in matter where FLP and Unity Fiji have filed case to declare Section 116 of Electoral Act unconstitutional

Chief Justice Kamal Kumar will deliver his ruling on notice in the matter where the Fiji Labour Party and Unity Fiji Party have taken the Speaker of Parliament, the Government and the Attorney General to court, seeking a declaration that Section 116 of the Electoral Act are unconstitutional, unreasonable, arbitrary, unfair, invalid and unenforceable.

While making submissions, FLP and Unity Fiji lawyer, Sevuloni Valenitabua says they are also seeking a declaration that political parties and candidates for election are not budget sector agencies or off-budget state entities and ought not to be compelled to satisfy such cumbersome provisions of legislation warranted only for the budget sector agencies and off-budget state entities which are funded by and through the government.

They also seek an order that the provisions of subsection 4C and 4D are unconstitutional and null and void.
