Court refuses application to uplift stop departure for Aliz Pacific’s Zarin Khan

Court has refused to lift a stop departure order imposed by the FICAC on Aliz Pacific partner Zarin Khan due to an active ongoing investigation.

FICAC says Khan, through his counsel from the law firm of LalPatelBale filed an application seeking orders to be uplifted to allow him to travel overseas for medical purposes.

FICAC Principal State Counsel Lilian Mausio objected to the application stating that the Court did not have jurisdiction to hear the matter and that the applicant is misconceived.

She says Khan has not been charged, hence the Section 5 (2) of the Criminal Procedure Act did not apply.

Resident Magistrate Semi Babitu says the Court did not have jurisdiction to hear Khan’s application since the order was made by the Commissioner of FICAC who was within her right under the FICAC Act.
