Sia wins custody battle against ex-husband Daniel Bernad

Australian singer and songwriter Sia has scored a significant legal victory in her divorce from her second husband, Daniel Bernad, after a judge rejected his emergency request for full custody of their one-year-old son.

According to TMZ, the judge ruled that most of the claims made in Daniel’s legal documents were not new, noting that the same information had been known since August.

At that time, the pair agreed on a temporary custody arrangement granting Sia primary custody of their son, Somersault Wonder Bernad, while Daniel was allowed limited, monitored visits.

Daniel had sought an emergency order for sole custody, accusing Sia of being a “serious and immediate danger” to their child due to alleged drug use.

However, Sia’s legal team argued that there was no new evidence to justify changing the existing arrangement.

They also reminded the court that Daniel’s visitation rights had initially been restricted because he was under investigation by the LAPD for alleged involvement in child pornography — an investigation that has since been closed without any charges or arrests.

Daniel has denied any involvement in such offences and claimed that Sia may have “planted evidence” to limit his access to their son.

Sia, who has publicly stated that she has been sober for over six months, said she has consistently agreed to drug testing for both parties, alleging that Daniel has refused regular testing himself.

In her divorce filing, Sia cited “irreconcilable differences” and requested both legal and physical custody of their child, while expressing openness to Daniel having visitation rights.

In addition to the custody dispute, Daniel has reportedly been seeking spousal support, asking the court to order Sia to pay him more than $700,000 per month.

This marks Sia’s second divorce; she previously separated from filmmaker Erik Lang in 2016 after just over two years of marriage.
