The Executive Director of Oceania Hospitals, Pramesh Sharma has been acquitted of all the charges laid against him after the Office of the Director of Public Prosecutions withdrew all the charges following a submission by the defence.
Sharma who was charged with 12 counts of indecently insulting a person, appeared before Magistrate Waleen George this morning.
The defence led by Devanesh Sharma had made an application for the charges to be dismissed as they were in contravention of Section 187(2) of the Criminal Procedure Act, which requires a complaint relating to a summary offence, which has a penalty of maximum 12 months or less, to be complained of, or a Police report lodged within 12 months from the date of the alleged offence.
The defence said the offences complained of in this case dated back to 2018 and 2019.
The charge therefore was statute barred.
Magistrate George agreed with the application made by the defence and upheld legal submissions made.
The DPP then advised that they were withdrawing the charges and agreed with the submissions by the defence.
Accordingly, an oral application was made by the DPP under Section 169 of the Criminal Procedure Act and Pramesh Sharma was acquitted of all charges.
