Man on rape charge acquitted by High Court

A man who was facing a charge of allegedly raping his defacto wife has today been acquitted and discharged by High Court Judge Justice Paul Madigan.
Justice Madigan directed the three assessors to return opinions of not guilty after the woman told the court that she consented to the act of sexual intercourse with her defacto husband on the 27th of February last year.
The judge said the woman’s evidence in chief was ‘thin’ but enough to establish a case to answer for the accused to be put to his defense.
However, after the morning adjournment, the woman told the court in the absence of the assessors that she did not want to proceed with her complaint of rape because there was nobody to provide for her and her two children.
When the cross examination continued, the woman told the court that she was not raped.
