President of the Fiji Court of Appeal Justice William Callanchini will deliver his sentence on notice after the mitigation hearing for the Citizen's Constitutional Forum and the Executive Director Reverend Akuila Yabaki's contempt of court case was heard yesterday.
CCF was represented by a Senior Counsel from New South Wales Neil Williams who made submissions saying what was published in their quarterly article did not have any scandalous information about the judiciary.
He submitted that CCF is willing to make an apology and the wordings have to be heard first by Judge Callanchini before it’s printed in the next issue.
Senior Counsel Williams also requested a non-custodial sentence.
Meanwhile, lawyers from the Attorney General's Office in their submission said Reverend Yabaki's actions pose a real risk in undermining the rule of law.
Ropate Green submitted that a fine of no less than $100,000 should be paid by CCF and Yabaki, a bond of $100,000 of good behaviour for three years should be placed on CCF and Yabaki and given the seriousness of the case, Green asked for a custodial sentence of no less than 6 months for Reverend Yabaki.
