Acting President of the Fiji Court of Appeal, Justice William Calanchini has dismissed the application for stay filed by suspended lawyer, Rajendra Chaudhry.
Chaudhry who is suspended from legal practice until 2017 by the Independent Legal Service Commission wanted a stay on the execution of the commission’s decision pending the determination of the appeal.
Justice Calanchini said the Fiji Court of Appeal has no jurisdiction to hear and determine such an application at this stage because the application for a stay must be made to the court below first.
