The closing submissions are underway in the case of two former executives of Post Fiji Limited.
FICAC lawyer, Rashmi Aslam told the three High Court assessors that the former managing director, Peni Mau did an arbitrary act by approving the payment of $5,400 to the then General Manager Finance, Dhirendra Pratap without the authority of the board and the Higher Salaries Commission.
Aslam said Pratap comes under the Higher Salaries Commission and the approval from the commission for payment is important.
He highlighted evidence given in court that the Managing Director cannot authorise any payment without the approval of the board and the Higher Salaries Commission.
He said that Mau acted according to his own wish.
Aslam also said that being employed in the public service, Pratap allegedly accepted $5,400 reward for performance of his duty.
He also said that Pratap’s contract mentions what he is entitled to and he cannot accept anything beyond that.
Mau is represented by Barbara Malimali while Pratap’s lawyer is Mehboob Raza.
